we give you advice that’s right for your situation, keep you in the loop at every stage, and work to sort things quickly and calmly.

Serving an eviction notice

The process for ending a tenancy depends on the type of agreement in place, the reason for eviction, and whether the tenant has breached their obligations. In some cases, landlords may seek possession without alleging fault, although this area of law is changing.

To be valid, most eviction notices must follow strict rules, including:

  • Providing the correct amount of notice
  • Using the right legal form or wording
  • Proving the deposit is protected
  • Supplying up-to-date compliance documents (such as gas safety certificates and EPCs)

If these conditions are not met, the notice may be invalid, delaying the process and increasing costs.

Because the law is under review, especially regarding “no-fault” notices, we recommend speaking with one of our solicitors before serving notice.

What happens if the tenant does not leave?

Evicting a residential tenant yourself rather than through a bailiff or high court enforcement officer could constitute a criminal offence. If a tenant does not leave by the deadline of the notice, the next step is to apply to court for a possession order. If granted, the tenant will be given a date to vacate the property.

If they still refuse to leave, you can apply for a warrant of possession. This allows court-appointed bailiffs to carry out the eviction. The process must be followed precisely, and we can handle all applications and correspondence on your behalf.

Our fixed-fee eviction service

We offer a fixed-fee service for straightforward eviction matters to give you clarity on costs from the outset. This includes:

  • Reviewing your tenancy documents
  • Preparing and serving a compliant notice
  • Advising on next steps if the tenant does not leave
  • Assisting with court applications where needed

For more complex matters, such as contested claims or claims involving rent arrears, we offer competitive, transparent rates and will always explain your options.

Eviction FAQs

  1. The cost depends on the complexity of the case. For example, a basic possession claim all the way through to enforcing a possession order might cost between £1,500 and £2,500, while more complex or contested matters may exceed £3,000. Court fees and enforcement costs (such as instructing a bailiff) are charged separately. We offer fixed-fee options where appropriate.

Yes, but only if the tenant leaves voluntarily after being given notice. If the tenant remains in the property after the notice period expires, you must apply to court. It is unlawful to remove a tenant yourself without a court order.

While not required by law, eviction is a technical area and mistakes can delay proceedings or lead to invalid notices. A solicitor ensures the process is handled properly, improving your chances of a successful and timely outcome.

Reforms are expected to remove the option of regaining possession without giving a reason (currently known as “no-fault” eviction). When these changes take effect, all evictions will need to rely on specific legal grounds. Our team stays up to date and can advise you based on the current law.
