Debt Recovery Solicitors

Debt Recovery Services in Romford and Essex

If someone owes you money, we’re here to help you recover it quickly, clearly, and with minimal stress. We support both individuals and businesses in Romford and Essex, whether you’re chasing an unpaid invoice, rent arrears, a personal loan, or funds owed by a former customer or contact.

We know how frustrating it can be when debts remain unpaid. Our job is to relieve that pressure by offering straightforward advice and managing the recovery process. Depending on the situation, we may take a firm approach or use a more tactful strategy, tailoring our actions to get the best results for you.

How Our Debt Recovery Process Works

  1. Letter Before Action: We’ll begin by sending a formal letter asking the debtor to pay within a set period. In many cases, this step leads to payment without further action.
  2. Negotiation: If payment isn’t made, we can help negotiate a repayment plan or settlement. Our team will guide you through the best strategy for your situation.
  3. Court Claim: If necessary, we’ll initiate a court claim to recover the debt. We handle the process from start to finish, ensuring everything is legally compliant.
  4. Enforcement: If the debtor still fails to pay, we’ll take enforcement actions, including using bailiffs, freezing accounts, or garnishing wages or property.

Debt Recovery Costs

The costs below relate to uncontested debt

We generally only act in claims over £10,000 in value, as it is often not cost-effective to instruct solicitors for lower value claims as the majority of legal costs will likely not be recoverable.

If the matter becomes contested or disputed at any stage, we will discuss any further work required and provide a revised estimate depending on the complexity and extent of additional work needed.

Hourly rates: £180 – £300 plus VAT depending on the level of legal advisor instructed.

Typical time required for simple uncontested claims: 3 – 6 hours There are various factors that determine the amount of work involved and we would always review the financial viability of your case at the very outset and once the claim has been issued if the matter is defended.

When claiming costs from the debtor, it is important to note that although we will ask the debtor to pay your fixed costs it is not mandatory that these will be paid. You can claim interest and compensation and we will advise you of the applicable rates.

Court fees that you will be required to pay in addition to our legal fees are (based on claim value):

  • £10,001 – £200,000: 5% of claim value
  • Over £200,000: £10,000

Additional court fees may apply depending on how the case progresses (e.g. hearings, enforcement).

Our estimate for uncontested claims typically include:

  • Taking your instructions, reviewing documentation, investigating debtors and advising on your legal position (including interest/compensation entitlement). This may include advising on the use of tracing agent searches or property searches to ensure there appears to be reasonable prospects of recovering the sum owed. Any such searches will attract an additional fee.
  • Preparing and issuing a legally compliant letter before action, outlining the details of your case, the extent of the legal relief you are entitled to and requesting payment from the debtor
  • Agreeing a settlement, payment plan or otherwise receiving the full demanded sum from the Debtor
  • Drafting and issuing a claim form to the relevant court if the debt is not paid and no settled agreement is made.
  • Applying to the court to enter a Judgement in Default if the debtor fails to respond to court proceedings promptly
  • Contacting the other side to request payment where a Judgement in Default has been issued by the court
  • In the event payment is not forthcoming, advising you on enforcement options and next steps. Separate court or third-party fees will be payable for enforcement of a Judgement.

Additional costs (if applicable):

  • Tracing agents
  • Financial viability searches
  • Enforcement searches

We will always advise you of additional costs at the earliest opportunity.

The costs above apply to uncontested debt claims only.  If the matter becomes contested or disputed at any stage, we will discuss any further work required and provide a revised estimate depending on the complexity and extent of additional work needed.

Debt Recovery Solicitor FAQs

We help recover unpaid invoices, rent arrears, personal loans, and debts from former customers or contacts.

An LBA is a formal letter setting out the grounds of the claim and asking the debtor to pay within a set timeframe to avoid court action. It often resolves the issue before legal action is needed.

If the debtor doesn’t pay, we can negotiate a payment, make a court claim, with a view to obtaining a County Court Judgment (CCJ), and thereafter take the appropriate enforcement action like using bailiffs or freezing accounts.

We normally only handle business debts of £10,000 or more.

Our hourly rates range from £180 to £300 plus VAT, depending on the legal advisor’s level. Simple, uncontested claims typically take 6 hours of work from the drafting the letter before action to obtaining a county court judgment.

Yes, court fees and costs for searches (e.g., tracing agents) or enforcement actions may apply. Court issue fees are based on the claim value.

We can apply for enforcement action, such as using bailiffs,  garnishing wages, or applying for charging orders on properties.

We assess your case’s viability, provide advice, and estimate the likely costs. If it’s worth pursuing, we’ll advise accordingly.

If the debt is disputed, we’ll discuss the next steps, provide a revised estimate, and consider legal action to resolve the dispute.

We will request the debtor pay your legal costs, but they are not obligated to, unless we get a court order saying otherwise. You may also be able to claim interest and compensation.
