2026 Changes to eviction notices from the Renter’s Rights Act

Abolition of Section 21 eviction notices

As of 1 May 2026, the Renters Rights Act is changing the way that eviction notices are handled and managed.

While the Act itself does provide more security for tenants, there is a risk that the proceeding time may see an increase in eviction notices being issued. No-fault evictions, often referred to as Section 21 notice, are to be abolished so eviction notices using Section 21 may be more prevalent in the time before these changes take effect.

Section 21 is a no-fault eviction, meaning that landlords are free to remove tenants without a reason, so long as they comply with the lawful process.

With this no longer in place,  Section 8 will be the primary means of eviction.

Changes to Section 8 eviction notices

  • Longer eviction notice periods to give tenants more time to move
  • Increased the grounds for possession while strengthening existing ones

How to serve an eviction notice after April 2026

The process for ending a tenancy depends on the type of agreement in place, the reason for eviction, and whether the tenant has breached their obligations. In some cases, landlords may seek possession without alleging fault, although this area of law is changing.

To be valid, most eviction notices must follow strict rules, including:

  • Providing the correct amount of notice
  • Using the right legal form or wording
  • Any tenancy deposit must have been handled in compliance with the relevant law

If these conditions are not met, the notice may be invalid, delaying the process and increasing costs.

Because the law is due to change imminently, especially regarding “no-fault” notices, we recommend speaking with one of our solicitors before serving notice.

What happens if the tenant does not leave?

Evicting a residential tenant yourself rather than through a bailiff or high court enforcement officer could constitute a criminal offence. If a tenant does not leave by the deadline of the notice, the next step is to apply to court for a possession order. If granted, the tenant will be given a date to vacate the property.

If they still refuse to leave, you can apply for a warrant/writ of possession. This allows authorised bailiffs to carry out the eviction. The process must be followed precisely, and we can handle all applications and correspondence on your behalf.
